POLICE AT WALMART STORE BRUTALLY ATTACK 54 YO GRANDFATHER
An Arizona man lay handcuffed and non-responsive on the floor of a Walmart on Black Friday, as his emotional grandson stood nearby. Jerald Newman, 54, spent Friday night in a Maricopa County jail hours after being arrested for allegedly resisting arrest and shoplifting, according to the county sheriff’s department. But the suspect’s family members, as well as at least one witness, said the man is innocent and that the treatment was unnecessary. Newman’s daughter said that she, her father and other family members were in the packed Buckeye, Arizona, store soon after it opened late Thursday night. “They were just letting people in; there was nowhere to walk,” Berneta Sanchez told CNN. “And teenagers and adults were fighting for these games, taking them away from little kids and away from my father.” The grandson, Nicholas Nava, told CNN affiliate KNXV that Newman had grabbed one video game and put it under his shirt so that others jostling for the game didn’t take it from him. One person alerted a police officer, who then approached Newman. David Chadd, a CNN iReporter from Las Vegas, was among those shopping for video games set up in the Walmart’s grocery section in a mass of people. He said Newman “was not resisting” arrest as he was led away from the crowd by a police officer. The fact that he was still in the store would leave me to question the actions of the cops in terms of defining theft, as to them being over zealous in doing their job is another issue. This guy should get a lawyer and go after Wal-Mart and the police dept.

@sneaubrey1 Thanks for your response. I make no secret of the fact that I despise Wall Mart. Are you comfortable with the idea of tax payers providing extra police security for Wall Mart? Remember that Wall Mart is private property. The police have no right to be there without a warrant, unless Wall Mart invites them. In which case Wall Mart should reimburse the tax payers?

@dalecs47 I personally do not know what goes on in other Wal-Marts, but I know at my local Wal-Mart, the Sheriffs Department was there, only because they knew there would be a huge crowd and the potential for…..well anything. Believe it or not Wal-Mart does go out of their way to try to make this “event” go off as safely and peacefully as possible!! The police presence in a Wal-Mart, at any time, to my knowledge, is solely at their discretion.

No he shouldn’t sue walmart, you enter at your own risk, he should sue the heck out of the police department and the individual officers for police brutality, unnecessary rougness and assault. @sneaubrey1 Setting aside all other issues, Let me ask this: What are the city police doing inside Wall Mart? If Wall Mart is contracting with the city police for added security then Wall Mart is 100% responsible for what they do. If there is no contract then why are the tax payers providing free police for Wall Mart? Does anyone know what the situation is?

@dalecs47 I am in no way saying that I agree with anything that happened, but to blame this solely on Wal-Mart is absolutely RIDICULOUS!! First of all Wal-Mart did not invent Black Friday, nor do they HAVE the police DO anything!! And what kind of protection do you suggest Wal-Mart provide?? Hired bodyguards for every customer, a personal escort, I could understand if it were a Wal-Mart security guard, but it wasn’t. The police are their own separate entity!!

@MoltaMagician Where are you getting all this information from? Is there video evidence that says he wasn’t “civil” or that he did in fact “resist”, because according to the few witnesses interviewed he complied with the officers. Not to mention the fact that he didn’t try to leave the store with the merch, and as far as the law states, its not theft until he attempts to leave without paying. So again, you’re taking the word of cops over the word of the people, because cops never lie, right?

I never said that all cops are good people but rather that he resisted their advance towards him and that he was slammed on the ground for it. He went down at a weird angle and hit wrong but had he just been civil or had he not put the item in his pants he would have come out just fine.
